As a condition of the Northumberland Valley Golf Club (the “Club”) accepting me as a member of the Club, I understand that I am required to sign this Waiver of Liability. I have had the chance to read this Waiver and the chance to obtain legal advice as to its meaning and have agreed to be bound by the terms of this Waiver of Liability.
I am aware that the activity of golfing and its related activities involves many risks, dangers and hazards to me and others personally and to my and their property including, but not limited to: being hit by balls, cars, or golf carts driven by others, coming into contact with the golf club of another player, carelessness or negligence of other golfers on the golf course, driving range, parking lot or clubhouse, sudden changes to or dangerous weather conditions, uneven or slippery terrain, and the fact that necessary medical care may not be available on a timely basis depending on the nature of the medical issue. I am also aware that the risks, dangers and hazards referred to above exist throughout all areas owned or operated by the Club (the “Club Property”).
I FREELY ACCEPT AND FULLY ASSUME ALL SUCH RISKS, DANGERS AND HAZARDS AND THE POSSIBILITY OF PERSONAL INJURY, DEATH OR PROPERTY DAMAGE OR LOSS RESULTING THEREFROM.
RELEASE OF LIABILITY AND WAIVER OF CLAIMS In consideration of the Club accepting me as a member which enables me to utilize the Club’s facilities and be present on the Club Property, and for other good and valuable consideration, the receipt and sufficiency of which is acknowledged, I hereby agree as follows: 1. I release the Club and its directors, officers, employees and representatives and their successors and assigns (collectively, the “Releasees”), from any and all liability for any loss, damage, expense or injury including death ( “Loss”) that I may suffer as a result of my membership in the Club or while present on the Club Property, including but not limited to those listed above, no matter how caused, including if caused by the negligence or gross negligence of any of the Releasees. 2. I hereby agree to hold harmless and indemnity the Releasees from any and all liability, claims, actions or damages that they may suffer or incur, without any limitation whatsoever, whether consisting of loss, property damage, death or personal injury, resulting from my membership in the Club or while present on the Club Property. 3. I agree that this Waiver is also binding on my heirs, executors, administrators, assigns and legal representatives. 4. I certify that I am 18 years of age or older and of sound of mind, or if I am under 18 years of age I have co-signed with a parent or legal guardian. I also certify that the witness to my signature on the Waiver of Liability read the document in my presence and that he or she is 18 years of age or older and of sound of mind.
In signing this release, I hereby acknowledge and represent that I have read this Waiver of Liability. I understand the terms and conditions of the Waiver of Liability and voluntarily agree to the entirety of the contents of the document, recognizing that by signing this document I am waiving certain legal rights which I or my heirs, next of kin, executors, administrators, assigns and representatvies might have against the Releasees.
This Waiver of Liability and any rights, duties and obligations as between the parties to this waiver of Liability shall be governed by and interpreted solely in accordance with the laws of the Province of Ontario and no other jurisdiction and any litigation involving the parties to this Waiver of Liability shall be brought solely within the Province of Ontario and shall be within the exclusive jurisdiction of the Courts of the Province of Ontario.
